description El objetivo de desarrollo sostenible de esta investigación fue la reducción de las desigualdades, como objetivo general se tuvo describir la importancia de la incorporación del test de proporcionalidad para cuantificar el daño moral en el Perú y como objetivos específicos: Analizar el test de proporcionalidad en la legislación comparada y en el Perú, mencionar la regulación sobre el daño moral en el Perú y por último indagar sobre los beneficios de la incorporación del test de proporcionalidad para cuantificar el daño moral en el Perú, la población total para el desarrollo de esta investigación estuvo compuesta por 7 entrevistados, dentro de los principales resultados se tuvo que los entrevistado coinciden al señalar que se debe optar por incorporar una herramienta que permita cuantificar el daño moral de forma objetiva, para evitar la arbitrariedad del criterio subjetivo del juez, finalmente como conclusión principal se tuvo que la incorporación del test de proporcionalidad a nuestro ordenamiento jurídico fue considerada como una herramienta que ayudaría a cuantificar el daño moral y de esa manera evitar la arbitrariedad del criterio del juez, como se viene dando actualmente, también fue descrito como un avance al momento de impartir justicia para las posibles víctimas.
