description El presente estudio es de tipo cualitativo, no experimental. Se realiza con el designio de dar a conocer el incumplimiento de las garantías constitucionales y derechos fundamentales por parte de Estado hacia los comerciantes ambulantes informales ubicados en el triángulo comercial del centro de Lima Metropolitana, ante la categoría: El derecho a la libertad de trabajo, encontramos derechos fundamentales donde el Estado tiene la obligación de garantizar un empleo formal a sus habitantes, pero en el Perú, El Instituto Nacional de Estadísticas e Informática (INEI) que es el Órgano Rector de los Sistemas Nacionales de Estadística e Informática, nos informa que solo el 22% de la población económicamente activa (PEA) cuenta con un trabajo formal. Por lo tanto se buscara evidenciar la vulneración de los derechos de la población que no cuenta con un empleo, de los comerciantes ambulantes informales ante la búsqueda de auto gestionarse económicamente, con este estudio queremos que se garantice y priorice al comerciante informal con el fin de promover condiciones adecuadas para la autogestión y su carga familiar.
