El presente informe analiza el procedimiento administrativo sancionador iniciado en contra de Petroperú por el incumplimiento de las medidas correctivas impuestas por OEFA para la remediación ambiental requerida luego del derrame ocurrido en la progresiva del km 41+883 del Tramo I del Oleoducto Norperuano, con especial atención al (i) Acta de Supervisión, y a (ii) la Resolución N° 1380-2014-OEFA/DFSAI, mediante la cual se inicia del referido procedimiento administrativo sancionador; (ii) la Resolución N° 844-2015-OEFA/DFSAI, mediante la cual se determina la responsabilidad administrativa de Petroperú y se imponen medidas correctivas a ser cumplidas por Petroperú; (iii) las Resoluciones N° 878-2016-OEFA/DFSAI, y N° 1283-2016- OEFA/DFSAI, mediante las cuales se declaran incumplimientos a las medidas correctivas y se imponen multas por dichos incumplimientos. Trabajo de investigación que investiga el material particulado sedimentable (MPS) y cómo desde la evaluación ambiental se puede mejorar la tutela de la calidad ambiental; en concreto, de la calidad del aire. En tal sentido, esta investigación abordará las definiciones y metodologías de medición del MPS, y cómo esta se vincula a la evaluación ambiental a cargo del OEFA. Posteriormente, se presentará una propuesta de parámetro MPS a efectos de que su incorporación pueda considerarse en el ECA Aire, bajo estándares de calidad regulatoria y prevención del riesgo ambiental.
