El tema de la corrupción en el Perú constituye actualmente un problema de difícil solución, tanto en relación alavance gradual del mismo, como en las escasas y poco efectivas maneras de combatirlo por parte del Estado.Asimismo, una de las tantas expresiones en las cuales la corrupción se presenta actualmente, es a través del llamado “lavado de activos”, conducta ilícita empleada por muchos funcionarios públicos con la finalidad de beneficiarse económicamente. En ese sentido, el autor desarrolla la problemática de estos dos delitos a la luz de la normativa penal, la relación existente entre los mismos, la grave afectación que generan, tomando en cuenta los diversos escenarios, y posibles mecanismos que se pueden emplear para combatirlos efectivamente, toda vez que la sociedad reclama, de manera urgente, frenar su avance y las fatales consecuencias que pueden ocasio...

Complex criminal acts do not only are that way due to their coordination and intervention methods, but also because of the political and economic power that their protagonists attend. The Peruvian case called Lava Jato is not only important because of it White Collar nature, but also because of the economic and political consequences.The complexity of a judicial case is measured by its evidence and its implications, therefore, it is necessary to split the main elements of the plot, link them with the criminality that supports it and interpret our criminal rules in a coherent and sustainable manner over time. The importance and valuation of the unfair of the extraneus in cases of great corruption is a good example of that task. 

The State delegates the provision of an important number of services of general interest for society, and the State delegates them to private economic operators. However, in these circumstances the need for regulation in order to achieve allocative efficiency underlies as a duty of the State.In this article, the author presents how the criminal offence of collusion is a way of regulatory capture, and how it brings along negative consequences for the social welfare and progress. The author also reaches a conclusion concerning which is the legal right protected with the aforementioned crime.
