El 23 de noviembre de 2015 se publicó la Ley 30364, Ley para Prevenir, Sancionar y Erradicar la Violencia contra las Mujeres e Integrantes del Grupo Familiar. Si bien la norma destacó por incorporar una serie de medidas principalmente orientadas a combatir la violencia contra la mujer, al parecer no presta el mismo grado de atención a las situaciones de violencia hacia niños/as, en concreto, aquellas que se producen en espacios no familiares. En el presente artículo, a partir de las carencias y omisiones que la normativa peruana presenta con respecto a la protección integral de niños/as contra la violencia en espacios no familiares, se propone algunas claves para elaborar un marco jurídico que aborde dicho asunto. This paper highlights the connections between representations of women with disabilities in mass media and the discrimination they face, in light of the State obligations derived from the Convention on the Rights of Persons with Disabilities (CRPD). The paper recognizes that this group faces intersectional forms of discrimination; because of this, the authors propose that a State obligation to prevent the perpetuation of stereotypes on gender and disability in mass media can be derived from a joint reading of CRPD and the Convention to Eliminate Discrimination Against Women. By analyzing representation in mass media, this paper finds that media outlets tend to convey false or protectionist stereotypes of women with disabilities. The present article has the objective of analysing the provisions that the peruvian State has been adopting for the implementation of the persons labour law with disabilities. In concrete, the article examines the provisions of the employment rate, the obligation to adopt reasonable settings and the bonification for the access to public employment. Additionally, it will develop some problems originated from this implementation and it will explain the remaining normative problems that still exist in the protection of other dimensions about labour colective law and people with disabilities.

El presente artículo tiene como objetivo analizar las medidas que el Estado peruano viene adoptando para la implementación del Derecho al Trabajo de las personas con discapacidad. En concreto, el artículo examina las medidas de cuota de empleo, deber de adoptar ajustes razonables y la bonificación para el acceso al empleo público. Asimismo, se desarrollarán algunos problemas derivados de esta implementación y se explicarán los vacíos normativos que aún existen en la protección de otras dimensiones del Derecho al Trabajo del colectivo de personas con discapacidad en nuestro país.

This paper raises the need of assessing a disability perspective in the Peruvian regulation related to children who lack parental care or who is under risk of losing it. To aim this objective, the authors develop the concept of intersectionality between children and disability and then identify the different exercise rights by these children that require the incorporation of this approach where is necessarily to adopt new measures.

The adoption and implementation of the Convention on the Rights of Persons with Disabilities drastically changed the understanding of the rights of persons with disabilities. The right to legal capacity (or legal agency) of persons with disabilities stands out, among other issues needed for its implementation. The Convention recognizes that persons with disabilities can make decisions and their disability is not ground for denying legal capacity. This goes against what most Civil Codes state in our region. To guarantee said right, it is necessary that States recognize support for legal capacity that are guarded by safeguards. These will prevent abuse, undue influence and conflict of interest. El entendimiento de los derechos de las personas con discapacidad se ha visto modificado por la adopción e implementación de la Convención sobre los Derechos de las Personas con Discapacidad. Entre los cambios necesarios para su implementación, resalta el referido a la capacidad jurídica (o capacidad de ejercicio) de las personas con discapacidad. A contracorriente con lo que se registra en la mayor parte de Códigos Civiles de la región, la Convención reconoce que las personas con discapacidad sí pueden tomar decisiones y que su discapacidad no puede ser motivo para privarlos de ese derecho.
