Esta ponencia evalúa el nivel de vulnerabilidad de los niños y adolescentes involucrados en un conflicto familiar que se somete a un procedimiento conciliatorio. Este se desarrolla en el ámbito judicial, en el cual se debe recurrir a la facultad del juez de aplicar un control difuso al acta de conciliación sometido a ejecución, para así poder evaluar si los acuerdos generados por los progenitores atienden de modo correcto a los derechos de los hijos involucrados, tomando en cuenta que son sujetos de derecho en igual condición que sus padres, y que tienen derechos de naturaleza legal y sociofamiliar diferentes a los de estos últimos. El reconocimiento de la multiculturalidad, plurilingüismo y la condición cultural histórica del Perú es un tema que aún no adquiere la importancia  que debiera tener en la agenda  política. Prueba de ello es que no existe una Política de Estado, ni políticas públicas, que se complementen  en la atención de las comunidades indígenas para generar una tutela dederechos progresista, autónoma y democrática. Las políticas públicas deben evaluarse desde dicha perspectiva de tutela, promoción y ampliación de los derechos porque no se puede construir un país en función de la exclusión de determinados grupos poblacionales.

Los contenidos de la cooficialidad idiomática en el Perú todavía no han sido resueltos y por eso se registran una serie de problemas de comunicación entre las autoridades que ejercen la dirección de una entidad pública con la población. El uso del quechua, aimara o lengua de señas provoca una diglosia comunicativa que perjudica sobre todo a las poblaciones más vulnerables, ampliando negativamente la accesibilidad a servicios públicos de justicia, de educación o de salud; especialmente porque se asume que solo el castellano es el único idioma que debe ser empleado desde el Estado. Ante esta perspectiva resulta importante evaluar y diferenciar los alcances de la cooficialidad idiomática, el uso de lenguas de trabajo y la comunicación establecida en el ámbito de la comunicación de una entidad pública con respecto de la población.

In recent years, the Brasilia Rules have enhanced the judicial and procedural parameters because they have regulated mechanisms for legal action in favor of persons in vulnerable situations. Consequently, they receive better attention in the protection of their rights. In effect, the Brasilia Rules improve the particular and special conditions of these persons. Special evaluation elements include: gender perspective, assistance to persons with disabilities, protection of the rights and interests of children and adolescents, guardianship of unprotected migrants, as well as a multicultural and bilingual perspective. These elements are the premises with which judicial systems in Latin America seek to efficiently address the demands that develop in their jurisdictions. The objectives and scope of the Code of Criminal Responsibility for Adolescents are dysfunctional when carrying out an evaluation of the jurisprudence of the Inter-American Court of Human Rights applicable to the stage of rehabilitation, resocialization and social reintegration applicable to «adults convicted of committing crimes» and to those «adolescent offenders», regarding the obligations of the State to provide procedural and constitutional guarantees to adolescent offenders in criminal proceedings when there are few Youth Centers where a socio-educational measure of hospitalization can be carried out. Consequently, a family uprooting is generated that limits the rights of these minors in the stage of execution of a sanction that in time is disproportionate and contradictory to the principles detailed in the Preliminary Title of the aforementioned norm.

Due to the lack of integration of Peru’s population for ethnic, social, demographic, and political reasons, the levels of violence and social exclusion have not been related to the need of training professionals in multicultural values. This need has only been addressed in the school context, yet the creation of bilingual and intercultural universities has also contributed positively. However, this may only lead to partial processes of development and population integration. Therefore, a proposal is made for training professionals, especially lawyers, to ensure a much more productive social integration process. Thus, the particular socio-legal contexts could be better understood, leading to a better protection of the rights of indigenous populations, especially in the judicial field.

The context of social violence affects the family sphere, generating a disproportionate increase in statistics in recent years, rendering the actions of the State sterile through its public entities. The study of the elderly population in the economic, legal, and socio-familial realms reveals certain characteristics and conditions that are not apparent in the design of public policies and commercial participation criteria of providers of goods and services in a consumer society. A distinction that allows for a subdivision within this population group is based on the particular characteristics acquired by those over eighty. This results in two autonomous categories that transform the traditional approach to evaluating the rights of these individuals.
