The analysis of cases in the labor and pension specialty is assumed based on the worker or pensioner who proposes the recognition of their rights. However, this reality extends to the family environment of the worker or pensioner, being a condition that cannot be analyzed by the judge due to the formal and direct evaluation of the claims or situations that may arise in a labor or pension judicial area that excludes the evaluation of any area other than what is predetermined in the scope of the process. In this way, the socio­family reality that every worker or pensioner registers is not analyzed in terms of the dimension and configuration of the “damage” that can affect the worker or pensioners because the violation of their rights cannot be limited to the individual context as detailed. by the Inter­American Court in the case “Muelle Flores vs. Perú”, because it is impossible to dissociate the family context from the person who proposes the recognition of his rights.
