This presentation is focused on advances and obstacles in the process of the constitutionalization of the Peruvian legal system, as it pertains to private law, labour law, and consumer protection, issues that have primarily been addressed by the Constitutional Court. The purpose of this exercise is to identify some of the strengths of this process, in broad strokes, mostly with regard to the protection of fundamental rights and their enforcement in relationships between private individuals. It also seeks to identify and reflect on —through two cases, one involving the protection of the right to collective bargaining, and the other involving the right to freedom of thought— the limits of constitutionalization, as a process and a result, in political relationships and decision-making.

En el presente trabajo daremos cuenta de cómo el proceso de descentralización incide en la satisfacción de los derechos sociales y el nivel responsabilidad de cada nivel de gobierno respecto a estos derechos fundamentales. Con ese objetivo, en la primera parte de este artículo revisaremos cómo el Estado social y democrático se relaciona con los derechos sociales y cuáles son las principales características de estos derechos; en particular, su sujeción al principio de progresividad y cómo este demanda la continúa actuación del Estado para la plena realización de los derechos fundamentales sociales. Historically, fundamental rights have not been perceived in their totality with the same degree of enforceability. However, with the contributionsof both the doctrine and the jurisprudence, todayall fundamental rights, including those with social character, are considered to impose real obligations on the State.In this article, the author shows how the decentralization process has influenced in this phenomenon, with emphasis on the right to education, and presents an analysis regarding the actual situation of this right in our country based on the positive actions that are under the responsibility of the Ministry of Education and the decentralized organisms.
