description El derecho sucesorio peruano, siempre ha buscado la protección de la familia; demostrándolo en su regulación actual, en la cual podemos observar que se brinda seguridad y protección a los herederos forzosos, respecto a los bienes del causante; primando la legítima ante la libertad de testar; sin embargo está protección no es suficiente; ya que actualmente el término familia se ha ampliado y el concepto de herederos forzosos no está acorde a nuestra realidad actual; puesto que ahora existen diferentes tipos de familia, alguno de ellas reconocidas por el Tribunal Constitucional, como la familia ensamblada y monoparental; y las que todavía no están reconocidas como las familias homoparentales pero que son una realidad palpable del día a día; es por ello que la presente investigación considera que es importante reflexionar sobre la modificación de la legítima y el concepto de los herederos forzoso; demostrándolo en uno de casos más controversiales, los hijos afines; que ellos también se encuentren regulados dentro de los herederos forzosos; así mismo a todos los miembros de las nuevas concepciones de familia y de este modo brindarles la seguridad jurídica que necesitan y que por derecho les corresponde.
