In recent years, there has been solid progress in the process of convergence between the international protection of human rights and the fight against corruption. One of the main challenges of this process is to find effective mechanisms for advancing in the interaction between the two agendas. To address this challenge, this article specifically asks: how can the phenomenon of corruption be incorporated into the international protection of human rights? To answer this question, we analyze the various procedures available to international human rights organizations to establish how it is possible to incorporate the phenomenon of corruption into international oversight. The central proposition is that through a strategic approach, the main obstacles that hinder the full realization of the potential of the convergence process between the two thematic agendas can be resolved. In the articl...

This paper is about the violence against the women and over its sexual and reproductive rights, from a human rights approach. The author remarks the constitutionalizing of the human rights and she says that addressing the violence against the women from this approach is valuable. That allows us to generate regulatory provisions that explicitly reflects the women’s rights. Likewise, it should be said that violence against the women is a human rights problem, in this way, the State and society have obligations to obey to their nationals and to the international community. These obligations came from the diverse international instruments in which the violence against women is considered, as well as the obligations that derivate from these instruments in order to eradicate it. Also, it is understood that the sexual and reproductive rights had been developed in an international level,...

ABSTRACT People with disabilities are part of vulnerable minorities, on them and their image, the use of obsolete terminology in the current media falls. The objective of this research it was to analyse the social representations of people with disabilities in the Spanish media, as a constitutive factor of social reality, social representation. It was examined, quantified, analysed, and interpreted, how people with disabilities are represented in a recent period, through a retrospective content investigation, which allows us to visualize and quantify that reality, facilitating actions focused on promoting equality, that which should always prevail in a just and equitable society. The data collection for the study was both qualitative and quantitative through selected articles for 36 months (2017-2019), from four Spanish presses. 677 articles related to disability were obtained. The best criterion to understand the importance of the right to adequate housing or decent housing is its legal foundations. The problem is that a lot of ink has been spilled by lawyers and judges without distinguishing that when it comes to human rights such as decent housing, there are two types of foundations: visible foundations and invisible foundations. The first has to do with the international and national regulatory framework; while the latter have to do with the moral weight that said regulatory framework has. In the present work, the visible foundations are preeminently exposed, and a preliminary outline of the invisible foundations is left.

In this article, I propose to address the national configuration of the political right in Colombia based on the well-known analytical distinction elaborated by Raymond Williams of emergent, dominant, and residual. Therefore, it is not just about the new rights, but emergent rights that allow us to think about their articulations, distinctions, and tensions within a political field of forces that unfolds in specific national formations contexts. The first part of the article addresses some of the characteristics and contrasts that currently define the residual, dominant, and emergent rights in Colombia. To do so, it is considered pertinent to think from the historical and contextual specificity of the field of trends and forces that constitute what is proposed in terms of the national configuration of the political right. The analysis of the discourses and political subjectivities of the...

The Guiding Principles on Internal Forced Displacement have established the guidelines for the management of this problem at a global level, which, far from diminishing, has increased especially in recent decades, due to natural disasters and their close relationship with climate change. The central problem is that, as it is a “soft law” norm, each State decides whether to implement it internally or not, leaving in limbo the guarantee of human rights of people who must be forcibly displaced within States, due to the disaster or as a form of preventive evacuation. The lack of knowledge or recognition by States of such displacement and its various causes, including natural disasters, has promoted legal clinics as the ideal space to make the problem visible and take action, from the structure of the clinical model, to advance in the protection of human rights of the population displaced...

Education is a starting point to access and understand as individuals and society to the great changes we experience daily, especially when we talk about scientific, technological, and humanistic progress. However, we cannot speak of the universality of a right if we fail to guarantee it to all sectors of the population, especially to groups in vulnerable situations. This notion becomes fundamental when we considering the context of disability, since about 15% of the world's population - 1.3 billion people, which is approximately the population of China - constitute a sector that is not very visible and needs to be addressed. Therefore, this essay seeks to clarify some conceptual generalities about the binomial right-education and the need for it to respond more effectively to the dynamic demands of the different social sectors. With this in mind, we will stick to the normative, institut...

In the standard manuscript of the Laws —the Parisinus Graecus 1807 of the 9th Century AD— this dialogue is placed between the Minos and the Epinomis. While in the Minos the pupil refers to the diversity of rites and traditions that can be observed amongst different peoples, the Epinomis stresses the unity of the law. The regulation of symposia, the access to drugs, to intoxicating drinks and to medicine is a fundamental theme of the Laws. This is evident already from the composition of the dialogue, since this theme is discussed in its first books. The art of regulating communal life is shown as a technique that can be perfected through dialogue. Communal drinking can be beneficial, says the anonymous Athenian foreigner, since wine encourages citizens to sing, and through the confrontation with pleasure citizens are able to exercise temperance. Since the consumption of wine may also ...

The fight against LGBT rights and the gender approach in Peru has been led mainly by the conservative evangelical countermovement, made up of evangelical churches, organisations and actors. This article identifies the main allies of the countermovement and analyses the countermovement's relationship with each of them. It argues that the backing of conservative members of Congress, the alliance with the Catholic Church and the support of transnational pro-life and pro-family networks provided a series of institutional, political, organisational and economic resources that increased the countermovement's chances of success and enabled it to mobilise in different arenas and at different levels. It was found that conservative members of Congress used their legislative powers and prerogatives to stop or reverse pro-LGBT rights initiatives in Congress, and their political capital to make visib...

Telework has reconfigured labor relations in organizations and made more visible the mental health problems that affect workers. The intensive use of new information and communication technologies, the overload of work, the extension of working hours, and the blurring of boundaries between the world of work and the family, among other typical factors of teleworking, are significantly affecting mental health. Mental disorders such as workrelated stress, depression, anxiety, and exhaustion are becoming more common. This new scenario has generated a legal response. In our country, the Telework Law, and its Regulations, among other rules, provide important but insufficient and limited legal treatment on the subject. Therefore, it is imperative that new legal tools are developed so that the operators of the law are better qualified to settle disputes relating to the protection of workers’...

This document describes the inclusion of the montuvio people in Ecuador, through democracy. It can be explained by its ethnic complexity and cultural self-recognition as a minority that has diversified its ethnic map, legitimating itself in the law of rights of the montuvia ethnic group by the Ecuadorian State. In this way, it succeeds in inserting itself into public national planning and, the need for a critical analysis to understand its historical participation. In recent studies, it is established that since the 1990s the Montuvio people have been significantly visible. With the creation of several state institutions, "the first recognition made in 2001 by the Ecuadorian state of the presence of montuvios in the political and social scenario of Ecuador, with the creation of the Council of Development of the Montubio People of the Ecuadorian Coast and Subtropical Zones of the Coastal ...
