During good weather, force the current Civil Code, our Supreme Court held that the legal act concluded by an agent without power was voidable in accordance with the possibility of "cure" under Article 230 of the Civil Code. Thus, on the basis of an unwarranted reductionist approach also grossly confused the concepts of confirmation and ratification, it was understood that a "flawed" business could be void or voidable, depending on whether the defect containing or could not be remedied. It became necessary to establish firm and solid institutional positions, that are respectful of the constitutional and legal current parameters. To know which is the position of the Judicial Power in certain matters, to let know that in front of the present bond, on which the Constitutional Court has been talking about, it must exist a real vocation to establish basic consensuses and generate a good coordination for one better integration, to formulate proposals and reforms, same in constitutional as legislative level for our country. Following this path, the Judicial Power must settle a position on certain matters in special of the constitutional procedural law, in order to them to addressed and resolved opportunely by the competent organs.

All legislative acts shall have continuity in time. However, sometimes these acts contain defects that cause their unconstitutionality and the subsequent expulsion from the legal order. The important question that arises is: When can a legislative act be declared unconstitutional? Whichare the defects that cause the expulsion of a law from the legal system?In this article, the author seeks to address these questions through a presentation of the legal defects that cause the invalidity of an act. The author pays special attention to the discussed legislative power excess defect, contrasting foreign case law with jurisprudence from the Peruvian Constitutional Court to determine if it is enough for an act to have this defect to be declared unconstitutional.

This paper examines the political and criminal implications of Jakobs' recent conception of the Peruvian judicial system within a state where the Constitution is the supreme rule. The analysis highlights the shortcomings of Jakobs' thesis of positive general prevention in relation to the function of criminal law in our legal system. The article argues that Jakobs' approach disregards important constitutional principles and fails to consider fundamental rights that protect individuals from excessive use of punitive power by the State. This can lead to a dangerous weakening of the role of the courts. Consequently, this would undermine the functions of judicial operators and increase the power of the criminal legislator, which is not in line with the principles of a democratic state.

Energy drinks have a history of over a century, but it is since the 1980s that they began to gain popularity, and in the Peruvian case, since the arrival of Red Bull in 2002. The text explores the power of language and its relationship with the state and biopolitics, arguing that words, though seemingly neutral, are inherently powerful tools. Language, always carrying an excess, becomes a means for state control, constructing and regulating lives by imposing limits and exclusions. Theories from Roland Barthes, Judith Butler, and Antonio Negri illustrate how language can be both oppressive and resistant. This interplay of forces reveals language as a potential source of transformation and defiance against power.
