During the 90s, the Peruvian government implemented a series of economic and tax to promote investment in the country. This article, after almost two decades and with the assumption of the changes that have arisen, will make a brief review of the background to the enactment of Law No. 30230 with regard to new investments not provided for in the Legal Stability Contracts. From ment, will show how the Law N ° 30230 institutionalizes a misinterpretation of the rules governing legal stability contracts. Then, we will discuss the reasons why the current regulation is not an appropriate tool to promote investment.Finally, we introduce the synthesis of this article through the conclusions.

Acid mine drainage (AMD) or acid rock drainage (ARD) refers to the effluents from coal and metal mines. AMD is a common phenomenon which occurs naturally as a process of rock weathering, but is increased in large scale due to human activities such as construction contracts (transportation corridors, dam build, etc.) and mining operations. This phenomenon denotes the acidic water that is produced during exposure of sulphide minerals (mainly pyrite) to air and water through a natural process, and creates sulphuric acid. AMD is a hazard to animals, aquatic life and human beings as it increases the acidity and dissolves metals. Preventing and treating AMD is an important issue in a mine site not only during operation life but also after the mine is abandoned.

This article describes and analyzes the national standard established for the prior consultation proceedings in mining and its relationship with environmental law. These procedures have been created in order to comply with the liability contracted by the Peruvian State in 1995, after the ratification of ILO Convention 169. The article reviews the main elements of Peruvian prior consulting process, including key aspects such as the identification of indigenous peoples, as well as defining the moment at which consulting should be made in the mining area. Finally, the author stresses the no consultations in mining projects at the time and the implications of that fact.

Durante los años 90, el gobierno peruano implementó una serie de medidas económicas y tributarias para promover la inversión en nuestro país. Este artículo, después de más de dos décadas y con las modificaciones propias de estas medidas, hará un breve repaso de los antecedentes a la promulgación de la Ley N°30230 en relación al tratamiento que se da a las nuevas inversiones no previstas en el Contrato de Estabilidad Tributaria. Luego, se mostrará cómo la Ley N° 30230 institucionaliza una errónea interpretación de las normas que regulan los Contratos de Estabilidad Tributaria. Asimismo, se expondrán los motivos por los que la regulación vigente no resulta ser una adecuada herramienta para promover la inversión. This articles is divided into two sections: the first presents the most solid quantitative series on Peruvian production and commerce during the transitional period of independence. From the series is can be deduced that emancipation brought with it a contraction of production and commerce which was prolonged well into the second half of the nineteenth century. The second section deals with the characteristics of the state political economy after independence, particularly between 1821 and the 1870s. What stands out is official state neutrality with regards to mining and fiscal mitigation. These measures provoked complaints at the time and brought about the contraction mentioned above. But it also meant a certain amount of wellbeing for the Indians which was manifested in their demographic growth during the nineteenth century.
