The so-called Genetically Modified Organisms (GMOs) constitute a true revolution of biotechnology. The nutritional improvements at the genetic level represent the main objective for the production of “transgenic foods”. However, despite the benefits of using these techniques derived from research in cellular and molecular biology, this has not prevented taking into account safety issues related, mainly, to the packaging. Therefore, the present work raises some reflections on the new challenges facing the law before these new foods, specifically, in terms of labeling, based on what is established by international instruments and the experience given in developed countries, to finally provide a legislative initiative able to safeguard the fundamental rights of consumers.

This study analyzes the violation of the respondent’s right to defense in the administrative prior approval (visto bueno) procedure in Ecuador, caused by the insufficient time granted to respond to the petition. Using a qualitative approach and exegetical and hermeneutic methods, the Ecuadorian legal framework (Labor Code and Ministerial Agreements MDT-2024-041 and MDT-2025-043) was examined and compared with international legislation (Peru, Colombia, and Chile). The findings show that the current two-day deadline is incompatible with Article 76, paragraph 7, letter b) of the Constitution, which guarantees adequate time and means for a fair and technical defense. This situation worsens when immediate suspension of the employment relationship is requested, depriving the worker of access to their workplace and documentation. The legal comparison revealed that Ecuador is the only country ...

At present there is a consensus in recognizing the importance of institutions, rules of society: formal and informal-to explain both success and failure of countries seeking development. In this perspective, Peru has not reached the longed-economic development because there is a weak institutional framework and does not effectively protect individual rights. The institutional framework has led throughout our history, the establishment of forms of government, populist and authoritarian. Our judicial system is not working properly: the judicial processes are inefficient (high cost and slow processes), there is political influence, court decisions are uncertain, there is widespread corruption, and access to justice is uneven. As a result of these characteristics, the legal system promotes legal uncertainty. In addition to the above, do not have a strong political party system. The instituti...

Variants of the genes ABCB1 and ABCC2 have been associated with an increased risk of drug-resistant epilepsy; this phenomenon, however, has been scarcely tested by means of comparisons between populations: In Latin America there have only been 3 studies. Objective: To evaluate the association between the variants C3435T of the gene ABCB1, and --24C> T of the gene ABCC2 with drug-resistant epilepsy in Peruvian patients treated at the Epilepsy Unit of a Peruvian Hospital. Material and Methods: Blood samples from 22 patients with drug-resistant epilepsy and eight patients with pharmaco-responsive epilepsy were analyzed between May 2016 and June 2017. The identification of the C3435T variant of the ABCB1 gene was performed by polymerase chain reaction (PCR) and subsequent enzymatic digestion; the -24C>T variant of the ABCC2 gene was obtained by sequencing. Results: An allelic frequency...

In this article, we explore how a group of judges describe their experiences with the lack of knowledge displayed by lawyers who litigate before their courts. Through narrative interviews with five judges from the module of the National Specialized Justice System for the Protection and Punishment of Violence against Women and Members of the Family Group (SNEJ), we find that litigators are portrayed as professionals who do not do their homework, fail to prepare, lack even the minimum knowledge required before entering a hearing, and normalize their own ignorance. In response to these situations, judges present themselves as figures of authority who seek to preserve the integrity of hearings by giving lawyers a few minutes to read the case file, guiding them so they can fulfill their role, reprimanding or firmly exhorting them, or even urging defendants to change lawyers, among other measu...

This article focuses on the challenge of building a history of contemporary dance in a country like Colombia, where we lack a documentary background and a legacy of historical construction based on the institutionalization of the archive. For this end, we analyze in the first place the notion of archive in the universe of Western dance, to later review its possibilities and expansive powers that transcend its materiality. "Archiving the ephemeral" refers to the dilemma of turning dance into archive, when it is ephemeral in nature, and thus opens the possibilities of building not a history, but a conglomerate of histories that sustain their unfolding in memory, orality, movement, gestures and specially in the body. This analysis focuses on the study of three scenic projects of Colombian artists, through which these questions are projected and raised within a theoretical, practic...

In this paper, I claim that Cuniraya Huiracocha, Huatiacuri and Pariacaca, which are lacking subjects, act as tricksters under the form of huacchas to obtain a particular object of desire through which their lack becomes fulfilled: Cuniraya Huiracocha tries to keep the maiden Cahuillaca, which leads to the reorganization of the Andean fauna; Huatiacuri, through his incorporation to a nuclear family, prepares Pariacaca’s arrival; and Pariacaca, through the demonstration of his power, and being recognized 318 Lexis Vol. XXXIX (2) 2015 and confirmed as deity, seeks to establish and consolidate a new regime, which he himself will rule. Based on this discussion, I explore a ChristianAndean plan of salvation due to the parallels between Cuniraya and the Creator God, Huatiacuri and John the Baptist, and Pariacaca and Jesus, where acting as trickster plays a crucial role.

This article proposes an approach to contemporary transformations of the legal, from the articulation between critical theory of law and the Lacanian left. On the one hand, it is stated that in contemporary times, under the dominance of the capitalist discourse, the legal has undergone a metamorphosis that can be characterized as the passage from bourgeois legal form to the right to jouissance. On the other hand, this paper claims that the law of populism can become, as residue of that discourse that it fails to reabsorb, a device capable of producing cuts on the capitalist circuit. In this context, the capitalist revolution refers to the radical change in policies and institutions and legal forms that lacks an emancipatory orientation and, on the contrary, promotes the consolidation and deepening of its repetition and reproduction. In this sense, identification with the subversive can b...

The current article aims to promote the integration of works of literature into the early years of legal education with the objective of training better legal professionals. Discussed are reasons for and ways by which these disciplines can be integrated with a particular focus on the contribution of poetry. The article reviews how poetry can help improve the quality of writing, oral expression, and how it can help promote creativity and detach us from the automatisms of our attention. In addition, it reviews how poetry can play a fundamental role in survival within the hostile environment of the field of law. Finally, it discusses how poetry may offer tools for dealing with the unknown and exploring areas in which we lack training, as they quickly become elementary in a world that has been transformed into a large question mark.
