This article analyses the structure of so-called crimes related to breaches of duty and special crimes of duty. It specifically aims to understand the foundation of duty that forms this structure. To achieve this, the research focuses on the various concepts of “positive duty” that underpin the classification of a crime as either a violation of duty or a special duty. The goal is to demonstrate the significance of establishing a duty as positive. We will also explore how attributing criminal responsibility in certain economic crimes, such as unfair or fraudulent administration, relies on this foundation.

The Peruvian case called Lava Jato is not only important because of it White Collar nature, but also because of the economic and political consequences.The complexity of a judicial case is measured by its evidence and its implications, therefore, it is necessary to split the main elements of the plot, link them with the criminality that supports it and interpret our criminal rules in a coherent and sustainable manner over time. As soon as the spread of the covid-19 began, the media’s information production was affected by social distancing restrictions and journalists were exposed health hazards in an attempt to carry out their jobs. This study aims at learning about the transformations undergone by the television newscasts production in Peru, one of the most affected countries by the pandemic at a global level. Qualitative methods were applied through semi-structured interviews with journalists working during the said period, obtaining results that evince the implementation of several devices and unconventional or unsuitable television processes. The human being is distinguished from the other animal species by the consciousness he has of being inscribed over time. He knows that he is mortal, that his life will have an end, he also knows that it had a beginning which links this initial moment to the present moment. This continuity presents itself to his consciousness in the form of a narrative, rewritten throughout his existence. Human communities do not have a clear image of their birth and even less a prefiguration of their death, yet they act in a manner analogous to that of individuals, except that they are content to transmit narratives concerning the common past, shared by an important part of the population. This awareness of the past is what we call, in a very general sense, individual or collective memory. This text deals with these themes and evokes the cases of political violence in Cambodia and Peru.
