In October 2019, in Chile, a series of protests and demonstrations took place, which promoted the constituent process in that country. As a result, the Constitutional Convention was formed, a body that, after a year of work, created a new constitutional text that will be voted on through a constitutional plebiscite to be held in September of this year. In this context, the purpose of this interview is to analyze and evaluate the most important aspects of the constitutional process.

With the social outbreak in Chile in October 2019, a series of demonstrations and citizen mobilizations of different sectors of society began, which promoted various requests for social claims and demands. It is from this event that, on November 12 of that year, a presidential speech was issued, through which three major agreements were proposed to overcome the crisis that was being experienced, and one of those agreements was the agreement for a new constitution.This promise gave rise to the formation of the Constitutional Convention, the body which, after a long and arduous period of work, has recently presented a new draft constitutional text, which will be accepted or rejected by means of a plebiscite to be held in September of this year. In this context, the purpose of the interview is to analyze and evaluate the most decisive aspects of the constitutional process.

El objetivo de este trabajo de investigación es Mariano Ignacio Prado, natural de Huánuco, nació el 18 de diciembre 1825. Sus padres fueron don Ignacio Prado Zoroastra y Francisca Ochoa Tafur, quienes provenían de una familia modesta, dueños de una hacienda y dedicados principalmente a la actividad agrícola. Tras la temprana muerte de sus padres, mientras él era aún un niño, fue criado por su preceptor, el sacerdote Agustín Rato, quien se encargó de brindarle formación académica en Huánuco. This paper is divided into two parts: the first contains a series of discussions presented in the binational seminar for Critical Elections and Social Movements, which took place virtually with professors of the University of Santiago, the Catholic University of Lima and the Catholic University of Valparaiso in July, 2021, organized in collaboration with Professor Carlota Casalino. The second part of the paper addresses the further development of those events, taking place up to the third anniversary of the “social uprising” in Chile, in a radically different political context to the one of October, 2019, which seems to be the closure of a cycle (the constitutional issue yet to be resolved). This work explores some of the most relevant legal considerations on the relationship between encryption of private communications and some constitutional rights, with a focus on Chilean law. We maintain that there is an unresolved tension in the role of the use of communications encryption tools with respect to the exercise of these fundamental rights and public security. To do this, after briefly introducing the concept of encryption, we review the bases of the regulatory debate in the United States, essentially contained in its rules on intelligence and export control of encryption tools, and synthetically review the American constitutional debate. Regarding the European Union, we identify the main legal and political elements that are influencing the community’s pre-regulatory debate. Next, the main legal aspects involved in the use of encryption tools are characterized.

The Constitution and the Code of Criminal Procedure, as well as international treaties ratified by Chile, oblige the state to offer free legal assistance to those who require it, which is especially relevant in the criminal sphere. On the riots or social unrest that occurred in Chile in the last quarter of 2019 and early 2020, the Public Criminal Defense Office adopted a set of measures to offer legal defense to those who were detained or indicted by the criminal prosecution bodies. This research compares crime behavior in the country between 2017 and 2021 and identifies the social unrest crimes. These are a group of crimes whose frequency increased considerably during the turbulent months: 1) burglary, 2) public disorder, 3) disturbances to public order, and 4) attacks and threats against authorities. El avance de la neurotecnología, al intervenir directamente en la actividad cerebral, genera desafíos jurídicos que exigen una nueva respuesta normativa. En este contexto surgen los neuroderechos, una categoría emergente de cuarta generación orientada a resguardar la injerencia de la tecnología en la mente. Si bien su desarrollo aún es incipiente, con Chile como pionero en reconocerlos constitucionalmente, se propone su incorporación en el ordenamiento constitucional peruano para garantizar la autonomía personal frente al impacto de las tecnologías neurocognitivas.
