Describe las características del sector eléctrico peruano y explica por qué los concesionarios de la transmisión eléctrica se encuentran sujetos al principio de libre acceso y, cómo a raíz de este principio, se vieron obligados a suscribir un Contrato de Acceso y Uso para permitir que una empresa concesionara de telecomunicaciones acceda a su infraestructura para instalar fibra óptica. Posteriormente, se analiza la naturaleza jurídica de dicho contrato, así como el alcance la competencia otorgada a OSIPTEL para emitir Mandatos de Compartición. Concluido este análisis, se formulan posibles alternativas de solución a efectos de brindar seguridad jurídica y paz social.

La Historia verdadera de la conquista de la Nueva España por el capitán Fernando Cortés es un manuscrito de 382 folios, recto y verso (signatura MSS/2997 de la Biblioteca Nacional de España), de la autoría de Pedro Fernández de Pulgar (1621-1697). Reconstruye los acontecimientos de la ocupación militar de los territorios maya, tlaxcalteca y azteca por parte de las tropas comandadas por Hernán Cortés, hasta la capitulación de la ciudad de México Tenochtitlán. Basada en historias previas, esta versión realiza un balance histórico e intenta abatir la “leyenda negra”, cuyo origen atribuye a fray Bartolomé de las Casas.

The author is Pedro Fernández de Pulgar (1621-1697). La tesis tiene como objetivo aportar, en primer lugar, un mejor entendimiento del sector de telecomunicaciones, de su normativa y sus instituciones tales como la compartición de infraestructura de uso público; en segundo lugar, de las competencias que tiene el Tribunal de Solución de Controversias (TSC) del Organismo Supervisor de Inversión Privada (OSIPTEL), entre otras cuestiones generadas con ocasión a la controversia entre Red Eléctrica del Sur S.A. y Azteca Comunicaciones S.A.C., en torno a la Red Dorsal Nacional de Fibra Óptica (RDNFO). It is usual to think that between the historical processes of Peru and Mexico there are more similarities than differences.
