The present article addresses the issue about the differences between the Tineo Cabrera and Toledo´s precedents, which is about the clarifications made by the Constitutional Court concerning the fundamentals rights like prior and detailed notification and lifting banking secrecy made in assembly parliamentary. Likewise, give its opinion about the inquiry commissions performance and the improvements that must be implement to its objective actuation and non-arbitrary.

El presente trabajo de investigación tiene como objetivo fundamental dar a conocer que el Virrey Toledo fue un personaje que destaco en el proceso de dominación española al asentar un modelo administrativo que perduraría hasta finales del siglo XVII. Entre sus obras más destacadas fueron las reducciones, la mita minera y la muerte del inca Túpac Amaru, y a través de la investigación se originan varias interrogantes, ¿Cómo realizó el proceso de las reducciones? ¿Por qué España decidió enviar a Toledo? ¿Por qué fue tan radical en su decisión de matar al último inca de Vilcabamaba? La búsqueda de respuesta y el impulso por alcanzar un nuevo objetivo hicieron posible saber más del personaje y aspectos de su gobierno.

A primera vista pareciera que las políticas económicas del gobierno de Alejandro Toledo son la continuación del gobierno de Alberto Fujimori, sin embargo, hay diferencias fundamentales. La economía de los noventa estuvo enfocada en las privatizaciones, aprovechando la gran popularidad del Ejecutivo. El gobierno actual no pudo seguir con la política de privatización debido a la resistencia de la población y a lo poco que quedaba por privatizar. Ante ello, utilizó una forma de financiamiento distinta: la emisión de bonos soberanos. Dada la coyuntura electoral nos preguntamos ¿qué política y modelo económico ofrecerá el próximo gobernante?

Viceroy Francisco de Toledo (1569-81) both reviled and admired the Incas. Surprisingly, he identified exactly the same aspects of their rule to praise and to condemn. To supply a legal justification for the Spanish conquest of Tawantinsuyu, Toledo and his advisers set out to prove that the Incas met the definition of tyranny in Castilian law, as explained by Aristotle and codified in the Siete Partidas. Tyranny was defined by specific elements: state surveillance and control, a climate of fear, the destruction of civil society, social leveling, and a monopoly by the state over its subjects’ time, labor, and property. But even while condemning the Inca regime for these methods, Toledo came to believe that these methods had enabled the Incas to rule well and to create a prosperous society in the Andes. La presente investigación tiene como objetivo describir y a la vez evaluar las propuestas que sobre modernización y desarrollo del país llegó a formular Alejandro Toledo a lo largo del periodo comprendido entre el año 2001 al 2006. A lo largo de la investigación, encontramos que tales propuestas tienen como soporte una visión que se apoya fuertemente en un enfoque teórico que pone especial énfasis sobre el mercado y la libertad económica por sobre la igualdad, lo que finalmente se traduce en la búsqueda y el logro de la eficiencia y la competitividad de los mercados.
