Las técnicas utilizadas para la recolección de datos fueron el análisis documental que permitió recolectar, identificar, analizar y describir el contenido de libros, tesis, doctrina y legislación relacionados al tema de investigación mediante resúmenes, utilizando como instrumentos fichas textuales y cuadros. El instrumento usado fue la guía de entrevista, aplicándose la entrevista semiestructurada a abogados litigantes, cuyas respuestas dieron como resultado, que la maternidad subrogada no se encuentra regulada en el Perú, afectando emocionalmente a los participantes de la técnica; por lo que, es necesario una regulación que proteja los derechos de los padres contratantes, de la madre gestante y primordialmente del recién nacido, llegando a la conclusión que a pesar de que la maternidad subrogada no se encuentra regulada en el Perú, se viene aplicando reiterativamente con gran interés por parte de personas o parejas infértiles, y al no contar con una reglamentación clara y suficiente, vulnerando principios y derechos de los intervinientes en la técnica al existir un vacío legal en el ordenamiento jurídico, debe ser regulado de manera expresa por el Estado Peruano y el Derecho para evitar interpretaciones confusas y/o veredictos acérrimos.

Las técnicas utilizadas para la recolección de datos fueron el análisis documental que permitió recolectar, identificar, analizar y describir el contenido de libros, tesis, doctrina y legislación relacionados al tema de investigación mediante resúmenes, utilizando como instrumentos fichas textuales y cuadros. El instrumento usado fue la guía de entrevista, aplicándose la entrevista semiestructurada a abogados litigantes, cuyas respuestas dieron como resultado, que la maternidad subrogada no se encuentra regulada en el Perú, afectando emocionalmente a los participantes de la técnica; por lo que, es necesario una regulación que proteja los derechos de los padres contratantes, de la madre gestante y primordialmente del recién nacido, llegando a la conclusión que a pesar de que la maternidad subrogada no se encuentra regulada en el Perú, se viene aplicando reiterativamente con gran interés por parte de personas o parejas infértiles, y al no contar con una reglamentación clara y suficiente, vulnerando principios y derechos de los intervinientes en la técnica al existir un vacío legal en el ordenamiento jurídico, debe ser regulado de manera expresa por el Estado Peruano y el Derecho para evitar interpretaciones confusas y/o veredictos acérrimos.The general objective of this research work is to determine the need and importance of the Regulation Of Surrogate Motherhood in Peru, 2021. To meet the objective, a basic, cross. Sectional, qualitative approach and design study was carried out non experimental descriptive type. The techniques used for data collection were documentary analysis that allowed collecting, identifying, analyzing and describing the content of books, theses, doctrine and legislation related to the research topic through summaries, using textual files and tables as instruments. The instrument was the interview guide, carrying out the semi-structured interview with trial lawyers.
