La presente tesis titulada: “Criterios para la conversión de la Pena Privativa de Libertad”; aborda la problemática que se advierte en la práctica judicial, en donde los magistrados a cargo de Juzgados Penales Unipersonales de Trujillo vienen aplicando la figura de la conversión de la pena privativa de libertad regulada en el artículo 52° del Código Penal, principalmente a su discreción; esto es, deciden aplicar la figura en mención según su íntima convicción; lo cual, sin duda alguna, afecta no solo el principio o valor de la seguridad jurídica que se manifiesta en la predictibilidad de las resoluciones judiciales; sino que además, puede advertirse que estas decisiones no se encuentran debidamente motivadas conforme el ordenamiento jurídico lo establece. Así las cosas, la presente investigación en primer lugar tiene la finalidad de verificar esta errónea práctica judicial; y, luego de constatado el estado del derecho, poder elaborar en base a la doctrina y jurisprudencia, tanto nacional como internacional, criterios que permitan analizar de mejor manera cuándo aplicar la conversión de la pena privativa de libertad |

This undoubtedly affects not only the principle or value of legal certainty, which is manifested in the predictability of judicial decisions, but it can also be seen that these decisions are not duly motivated as established by the legal system.
