description Constituye objeto de investigación la problemática advertida en el ejercicio profesional del investigador como Fiscal relacionada con labores periciales enmarcadas dentro de investigaciones encomendadas sin necesidad de designación expresa a entidades especializadas conforme el numeral 2 del artículo 173 del Código Procesal Penal y la pretensión de la defensa de la parte imputadas de los hechos en investigación porque Peritos de parte intervengan en dichas diligencias, amparados si bien es cierto en el derecho reconocido a contar con dicho apoyo, pero que por imprecisión de las propias disposiciones normativas que la regulan, dada la especialidad y naturaleza de las mismas entidades especializadas es incompatible, surgiendo la necesidad no solo de exponer dicha realidad sino también de proponer alternativas para su superación. En el desarrollo de la investigación se recurrió a documentación doctrinaria especializadas que la respalden, así como a especialistas en el tema objeto de investigación, recabando valiosa información relacionada con la necesidad de efectuar precisiones relacionadas con la inaplicación de las disposiciones que regula la actuación de peritos de parte en las labores periciales encomendadas, sin necesidad de designación expresa; consecuentemente se planteó como interrogante del problema: ¿Que precisiones deben regularse por la labor pericial sin necesidad de designación expresa, para fortalecer la seguridad ciudadana, la lucha contra la delincuencia y el crimen organizado?
