En tal sentido, se afronta el siguiente planteamiento de problema, ¿De qué manera la regulación del hijo alimentista determina en el Prueba de filiación extramatrimonial? Logrando como conclusión principal es que resulta innecesario recurrir al hijo alimentista, cuya base es una sospecha de paternidad que solo garantiza el derecho alimentario, cuando puede iniciarse un Prueba de filiación extramatrimonial, en donde el menor sería sujeto de todos los derechos que derivan del vínculo filial. Este proceso conlleva una declaración de paternidad provisional y la oposición del progenitor sospechoso mediante la práctica del análisis de ADN. Dicho examen prueba, con certeza, el vínculo filial; por lo tanto, el menor accedería a mejores derechos.
