El presente trabajo de tesis, tiene como título “LAS INVERSIONES DE CORTO PLAZO Y EL DERECHO A LA LIBERTAD DE COMERCIO E INDUSTRIA EN EL PERÚ”, en el que se realizó un estudio sobre el comportamiento de las inversiones de corto plazo en un determinado periodo y su incidencia en el derecho a la libertad de comercio e industria. El problema planteado en la investigación es: ¿De qué manera los capitales de corto plazo afectaron el derecho a la libertad de comercio e industria establecido en el Artículo 59° de la Constitución Política del Perú durante el periodo 2004-2014? La hipótesis es planteada de la siguiente manera:” los capitales de corto plazo afectaron negativamente vulnerando el derecho a la libertad de comercio e industria establecido en el Artículo 59° de la Constitución Política del Perú, durante el periodo 2004-2014. La investigación según su fin es aplicada, según su alcance es explicativa y de acuerdo al diseño de investigación es no experimental o descriptiva longitudinal. Para la elaboración del presente estudio, utilizaron fichas, índice de datos, análisis bibliográfico y entrevistas a especialistas en la materia tanto a a especialistas en derecho constitucional, en derecho económico, y economistas. Para recopilar la información se utilizaron libros, revistas científicas y páginas web especializadas. Los Capitales de Corto Plazo en la economía peruana durante el periodo 2004-2014 aumentaron en forma progresiva y esto según especialistas origina un desbalance la economía peruana, no generan crecimiento económico, y afectan el derecho a la libertad de comercio e industria. Como resultado de la investigación se realizó la siguiente propuesta: AMPLIACION DEL ARTÍCULO 6 DE LA LEY DEL IMPUESTO DEL IMPUESTO A LA RENTA PARA LOS NO DOMICILIADOS QUE REALICEN INVERSIONES DE CORTO PLAZO EN EL PERÚ. |

The hypothesis is stated as follows: short-term capital negatively affected the right to freedom of trade and industry established in Article 59 of the Constitution of Peru during the period 2004-2014. The research according to its purpose is applied, according to its scope is explanatory and according to the research design is non-experimental or descriptive longitudinal. For the preparation of the present study, bibliographical data analysis, data index and interviews with specialists in the subject have been used, they are directed to specialists in constitutional law and in economic and international law. To compile the information, books, scientific journals and specialized web pages were used. Short-term Capitals in the Peruvian economy during the period 2004-2014 increased progressively and this, according to specialists, causes an imbalance in the Peruvian economy, delays and does not generate economic growth, and affects the right to freedom of trade and industry.
