description La presente investigación busca cuestionar el sexto precedente vinculante contenido en el Décimo Pleno Casatorio Civil emitido no hace mucho tiempo. La regla sobre la cual parte nuestra investigación, a nuestro criterio y basándonos en autorizada doctrina, resulta atentatoria contra diversos principios de orden procesal; en especial el de imparcialidad judicial; pues, si entendemos que la imparcialidad es aquella garantía procesal que impide al juzgador, sujeto ajeno a las partes en conflicto, comportarse o inmiscuirse en el conflicto inter partes, lo que quiere decir que dicho sujeto no pueda siquiera mínimamente realizar comportamiento alguno que permita inclinar la balanza de la razón a favor de alguna de las partes; por ello, cuando el juez trae al proceso civil medios de prueba de aquel demandado declarado rebelde, dicho medio de antemano y en el orden normal de los casos estaría siempre terminará favoreciendo a aquel demandado, ellos supone en todos los casos un reemplazo absoluto a alguna de ellas; pues, en palabras muy sencillas el juez está haciendo aquello que única y exclusivamente le corresponde hacer al demandado, contestar la demanda y con ello alegar hechos de defensa y ofrecer medios de prueba, dentro del plazo, que respalden tales hechos.
