description El presente trabajo de investigación titulado “Declaración referencial de la víctima en los procesos judiciales penales obtenida sin el uso de la Cámara Gesell” tuvo como objetivo determinar de qué manera a nivel de procesos judiciales penales se puede valorar la declaración referencial de la víctima aun cuando haya sido obtenida sin el empleo de la Cámara Gesell. La metodología empleada fue descriptiva, histórico jurídica, dogmática, analítica, sintética y sistémica, las técnicas fueron el análisis bibliográfico, el fichaje, el estudio de casos y la encuesta. Finalmente concluye que una prueba anticipada requiere de una audiencia para que pueda incorporarse al proceso penal, la declaración referencial de la víctima obtenida sin el empleo de la Cámara Gesell deberá ser sometida a una audiencia para que sea considerada una prueba anticipada y de esta manera no pueda ser desestimada, asimismo, es posible que se valore la declaración de la víctima aun cuando se haya obtenido sin el empleo de la Cámara Gesell, esto debido a que se agilizaría el proceso, y porque al ser una entrevista única, existe la probabilidad de que no pueda ser obtenida en otro momento, asimismo, varias Cámaras Gesell a nivel nacional se encuentran inoperativas, obligando a realizar la toma de declaración prescindiendo de este equipamiento.

The methodology used was descriptive, historical, legal, dogmatic, analytical, synthetic and systemic, the techniques were bibliographic analysis, filing, case study and survey.
