La importancia de determinar en qué registro debe conservarse radica en que el instrumento público notarial perdurará más allá de la muerte del notario y brindará seguridad jurídica no sólo a los contrayentes, sino frente a terceros, en virtud del principio de publicidad. Además, la investigación está orientada a proponer de ser el caso una reforma legislativa parcial del Decreto Legislativo del Notariado, en cuanto a los tipos de registros de manera que, dada la naturaleza jurídica del acto jurídico a tratar se evidencie una mejor conservación de los instrumentos públicos. La Ley N° 31643 dispone la competencia para la celebración del matrimonio civil ante notario público, es por ello que la presente investigación recolecta la opinión de los notarios a través de entrevistas y encuestas a sus trabajadores del despacho notarial, dichas técnicas han sido aplicadas en el distrito de Piura.

The importance of determining the record for its preservation lies in the fact that the public instrument will last beyond the notary's death and will provide legal certainty not only to the spouses, but also to third parties, by virtue of the principle of publicity. In addition, this research is oriented to propose, if necessary, a partial legislative reform of the Legislative Decree of the Notary Public, regarding the types of registries so that, given the legal nature of the legal act to be dealt with, a better preservation of public instruments is evidenced.
