description La prescripción es una institución jurídica que consiste en la extinción de la responsabilidad penal mediante el transcurso de un periodo de tiempo, en determinadas condiciones, sin que el delito sea perseguido o sin ser la pena ejecutada, considerando lo antes mencionado, existe un supuesto de reducción del plazo de prescripción de la acción penal, taxativamente prescrito en la norma sustantiva del código penal, para ser preciso el artículo 81, en ese sentido, la investigación radica en establecer los fundamentos constitucionales que permiten incorporar nuevos supuestos de reducción de los plazos de prescripción de la acción penal, ahora bien, considero que el principio de igualdad -Todas las personas nacen libres e iguales ante la ley, recibirán la misma protección y trato de las autoridades y gozarán de los mismos derechos, libertades y oportunidades sin ninguna discriminación por razones de sexo, raza, origen nacional o familiar, lengua, religión, opinión política o filosófica- sería una justificación relevante para incorporar nuevos supuestos al artículo 81 del código penal, asimismo, la aplicación analógica favorable, permite considerar un criterio para la creación de un nuevo supuesto de reducción del plazo de prescripción de la acción penal
