Sin embargo, desde una óptica normativa supranacional; y, a partir del análisis del principio de interés superior del niño, la regla antes mencionada parece perder solidez y coherencia en nuestro ordenamiento jurídico. Ahora, aquella regla pierde aun mayor solidez, cuando la miramos desde la óptica de un constructo jurídico denominado “derecho de relación”, el mismo que ha sido desarrollado en el presente trabajo, ello con el único objetivo de demostrar que la norma contenida en el varias veces mencionado artículo 88 del Código de los Niños y los Adolescentes, resulta ser inadecuado para el desarrollo psico emocional de aquel niño, niña o adolescente

Article 88 of the Code for Children and Adolescents; This is because this article has always been understood as a norm that contains a punishment for that father who, not exercising custody of his son or daughter, has not been fulfilling his duty to support.
