El método que se empleó fue una investigación con enfoque cualitativo, de tipo básico, de nivel descriptivo-explicativo y de diseño no experimental, teniendo como unidad de análisis a informes jurídicos, en donde se empleó la técnica e instrumento: análisis documental. Se obtuvo como resultado que el trabajo infantil no solo es una cuestión social, sino que, además dificulta el acceso a la oportunidad de educación, como también promueve la deserción escolar de los mismos, afectándose así el principio del interés superior del niño. Se concluyó que el trabajo infantil termina por perjudicar los derechos, dignidad humana y el interés superior de los niños y las niñas, exponiéndolos a condiciones laborales inhumanas, riesgosas y degradantes.

The method used was an investigation with a qualitative approach, basic type, descriptive-explanatory level and nonexperimental design, having as unit of analysis reports, where the technique and instrument were used: documentary analysis. It was obtained as a result that child labor is not only a social issue, but also hinders access to educational opportunities, as well as promotes their school dropout, thus affecting the principle of the best interest of the child.
