Sumario: | The present investigation considers that the disciplinary procedure against teachers for acts of sexual harassment, followed before the UGEL of Maynas in the year 2022. While it is true, it is based on the right to due process of the investigated teachers; however, it is necessary to analyze the protection of the best interest of the child in this type of procedure. In this sense, certain specific objectives are developed, in order to explain the treatment of the administrative disciplinary procedure against sexual harassment processes followed against teachers before the UGEL; likewise, the legal nature of the Principle of the Best Interest of the child that should be protected before the presentation of cases of sexual harassment in educational institutions was established; finally, the legal consequences that could result from the inadequate exercise of psychological assessment in the disciplinary process for sexual harassment were identified. Taking into account in the methodology, the qualitative approach of basic type for the analysis of the results found in this research. |
