description La figura jurídica de la prisión preventiva, en la actualidad ha ido desvirtuando su finalidad excepcional como medida cautelar, debido a que el Juez encargado de evaluar si para el petitorio se cumple con los presupuestos materiales consignados en los Arts. 268 al 270 del Nuevo Código Procesal Penal, sin embargo, se estaría dejando llevar en muchos casos por la presión mediática y con ello vulnerando el debido proceso. El objetivo general fue demostrar si la prisión preventiva, incide en la observancia del debido proceso en el Distrito Judicial del Callao. El tipo fue explicativo y el nivel aplicado; el método y diseño de investigación fue expost facto o retrospectivo; y la población estuvo constituida por el Colegio de Abogados del Callao (CAC) y la muestra de 317 Abogados con un muestreo del 95% de probabilidad de confianza y con un 5% como margen de error. Respecto a los instrumentos usados para medir las variables fue la técnica de la encuesta y como instrumento el cuestionario, siendo validado por Jueces expertos con el Grado de Doctores; finalmente la prueba estadística fue el chi o ji cuadrado, corregida por Yates. En conclusión, la prisión preventiva, incide significativamente en la observancia del debido proceso en el Distrito Judicial del Callao.

The general objective was to demonstrate whether the preventive detention, affects the observance of due process in the Judicial District of Callao. The type was explanatory and the level applied; the method and design of the research was expository or retrospective; and the population was constituted by the Bar Association of Callao (CAC) and the sample of 317 Lawyers with a sample of 95% probability of trust and with 5% as margin of error. Regarding the instruments used to measure the variables was the technique of the survey and as an instrument the questionnaire, being validated by expert Judges with the Degree of Doctors; finally the statistical test was the chi or chi square, corrected by Yates.
