Esta investigación se alinea con el Objetivo de Desarrollo Sostenible N° 16, orientado a promover sociedades justas e inclusivas, al abordar la falta de reconocimiento normativo de las familias ensambladas en el ámbito sucesorio peruano. El objetivo general de la tesis fue analizar de qué manera la falta de protección jurídica de las familias ensambladas afecta su derecho sucesorio en el Distrito Judicial de Cajamarca, 2024. Se adoptó un enfoque cualitativo, utilizando entrevistas a especialistas y análisis documental como métodos principales. Los resultados evidenciaron que el marco legal vigente se sustenta en vínculos exclusivamente biológicos o legalmente formalizados, lo cual excluye a convivientes no inscritos y a hijos afines, generando desigualdad en el acceso a los derechos hereditarios. Esta exclusión vulnera principios constitucionales de igualdad y protección de la familia. El estudio concluye que es urgente una reforma legislativa que reconozca los vínculos socioafectivos como base para el ejercicio de derechos sucesorios, garantizando así la seguridad jurídica y patrimonial de las familias reconstituidas. |
