Además, es de enfoque cualitativo con tipo de investigación básica y el diseño jurídico descriptivo. Habiendo utilizado las técnicas de investigación como entrevista, análisis documental, ficha de entrevista y ficha de análisis documental. Y, como resultado principal se obtuvo que, es necesaria la incorporación normativa de la maternidad subrogada, con el objetivo de erradicar aquel vacío legal que genera este problema, asimismo la regulación de la maternidad subrogada garantiza el derecho a la familia, el derecho a ser madre comitente o intencional. Concluyendo que, es de vital importancia que la maternidad subrogada altruista sea regulada y normada por las Leyes Peruanas.
