Se aprecia del Expediente N° 514-2002 (Primer Juzgado de Trabajo de Trujillo - Juez. Dr. Víctor Castillo León, Sec. Dr. Marco Conde Meléndez) que, mediante “Contrato Verbal” del primero de abril del año 1996, don José Armando MENDIBURO PÉREZ, ingresa a laborar como Agente de Seguridad de la Universidad Privada ANTENOR ORREGO con sede en Trujillo, región La Libertad. Luego de establecido el vínculo laboral, la entidad antes mencionada optó por suscribir con dicho trabajador sucesivos “contratos escritos a tiempo determinado” hasta el 31.07.2000 (nueve contratos en total), apreciándose “soluciones de continuidad” entre cada uno de ellos. Es el caso que, mediante Carta de fecha 21.07.2000, se comunica al mencionado trabajador que su relación laboral finalizaba el día 31.07.2000, hecho que es considerado como un DESPIDO ARBITRARIO y da lugar para que se solicite tutela judicial efectiva (22.03.2002), demandando (vía acumulación objetiva de pretensiones) el pago de INDEMNIZACIÓN POR DESPIDO ARBITRARIO y otras pretensiones. |
