A través de un enfoque cualitativo, se realizaron entrevistas a fiscales y abogados penalistas, complementadas con análisis de casos jurisprudenciales. Los hallazgos revelan una falta de uniformidad en los criterios aplicados por los jueces, lo cual genera inseguridad jurídica y afecta los derechos fundamentales de las víctimas y de los acusados. Se identificaron discrepancias entre la calificación de los hechos como tentativa de violación sexual o como tocamientos indebidos, lo que evidencia debilidades interpretativas en el sistema penal. Se concluye que es urgente implementar capacitaciones especializadas y reformas normativas que garanticen coherencia en la aplicación de la ley. Este estudio contribuye a fortalecer el acceso a una justicia más transparente, equitativa y predecible, conforme a los principios del ODS 16, y propone medidas concretas para mejorar la respuesta institucional frente a los delitos sexuales.
