La investigación abordó tuvo como problemática ¿Cuáles son los factores que determinan la vulneración al derecho al nombre?, toda vez que vulnera el Derecho al Derecho a la Identidad y carece de reconocimiento legal expreso, en consecuencia, originando problemas en el torno familiar. El objetivo general: Identificar los factores que determinan la vulneración al derecho al nombre en el caso JHOJANA RUDAS GUEDES 02970-2019-PHC/TC Material y método: El tipo de investigación fue dogmática jurídica y método dogmático, toda vez que estudia el contenido de la normatividad del ordenamiento jurídico y su interpretación aplicado a la presente investigación. El diseño: no experimental transeccional – correlacional. Resultado: El 66,00 % de 33 de la población encuestada respondieron que hay vulneración al derecho al nombre en el caso JHOJANA RUDAS GUEDES 02970-2019-PHC/TC. Conclusión: se identificó vulneración al Derecho al Nombre en el caso JHOJANA RUDAS GUEDES 02970-2019-PHC/TC de manera que, vulnera el derecho del progenitor, así como la facultad del beneficiario cambiar el orden de apellidos en función al Derecho a la Identidad y su composición no tiene reconocimiento constitucional expreso. |

The general objective: To identify the factors that determine the violation of the right to the name in the case JHOJANA RUDAS GUEDES 02970-2019-PHC/TC. Material and method: The type of research was legal dogmatic and dogmatic method,since it studies the content of the regulations of the legal system and its interpretation applied to the present research. The design: non-experimental translational – correlational. Result: 66.00% of 33 of the surveyed population responded that there is a violation of the right to a name in the case JHOJANA RUDAS GUEDES 02970-2019-PHC/TC.
