Se formuló como hipótesis general la siguiente: “Hay posibles afectaciones al interés superior del menor en supuestos de maternidad subrogada y están relacionados con el derecho a la identidad, dignidad y desarrollo integral.” Dentro del marco teórico se analizó doctrina peruana e internacional, así como derecho comparado que fundamentan el trabajo de investigación. La investigación fue cualitativa documental, la discusión de resultados se realizó de acuerdo a dicho enfoque. Las hipótesis fueron validadas y la principal conclusión arribada fue: “Hay posibles afectaciones al interés superior del menor en los supuestos de maternidad subrogada y están relacionadas con el derecho a la identidad a la dignidad y desarrollo integral del menor”. La recomendación fundamental está referida a considerar en el sistema jurídico peruano la postura dominante sobre la aplicación de la maternidad subrogada, de igual manera se debe tener en cuenta las implicancias jurídicas de aplicar está técnica.

The following was formulated as a general hypothesis: “There are possible effects on the best interests of the child in cases of surrogacy and are related to the right to identity, dignity and integral development.“ Within the theoretical framework, Peruvian and international doctrine as well as comparative law that underlie the research work were analyzed. The research was qualitative documentary; the discussion of results was carried out according to that approach.
