La entidad encargada de las fiscalizaciones debe agotar la vía administrativa antes de proceder legalmente, permitiendo que la Oficina de Procuraduría de la institución tome acciones legales en caso de persistencia en la conducta infractora. Cada gerencia, responsable de fiscalizar diferentes aspectos, emite un informe para iniciar acciones legales contra administrados que rechazan cerrar sus establecimientos o detener obras, entre otras infracciones. Si la denuncia llega a sede fiscal y se archiva, indica que la institución no ha agotado todas las vías administrativas. La ineficacia en esta fiscalización conduce a una sobrecarga laboral en la oficina de Procuraduría, obligada a actuar legalmente ante los informes de presuntos desobedientes. Esto se agrava cuando los administrados incumplen órdenes de la Municipalidad Distrital de San Sebastián, incluyendo clausuras y medidas cautelares. Este análisis busca destacar la necesidad de mejorar los procesos de fiscalización y notificación para reducir la carga en la Procuraduría y asegurar el cumplimiento de las disposiciones administrativas.

The entity responsible for the audits must exhaust the administrative route before proceeding legally, allowing the institution's Office of the Prosecutor to take legal action in case of persistent infringing behavior. Each management, responsible for supervising different aspects, issues a report to initiate legal action against those who refuse to close their establishments or stop works, among other infractions. If the complaint reaches the fiscal office and is archived, it indicates that the institution has exhausted all administrative avenues. The inefficiency in this supervision leads to an excessive workload on the Office of the Prosecutor, forced to legally act against the reports of presumed disobedients. This situation worsens when the administrators do not comply with orders from the San Sebastián District Municipality, including closures and precautionary measures.
