Para este lograr este propósito, en primer lugar, se aborda y estudia el escenario actual del arbitraje y la corrupción en el Perú, a modo de sentar una base para el posterior análisis de la práctica arbitral y su normativa, tanto a nivel nacional como internacional. Luego, el análisis se centrará en el rol del tribunal arbitral frente a las alegaciones de corrupción, desarrollando la posibilidad de pronunciarse sobre hechos delictivos, trayendo a colación distintos casos que ponen en evidencia la viabilidad del objetivo de la presente investigación, la aplicación del principio sua sponte y el estándar probatorio aplicado en los arbitrajes. De manera posterior, se desarrollará la función del laudo arbitral ante los indicios de corrupción, y se ahondará en lo relativo al deber de confidencialidad -si tiene o no carácter vinculante-, y en la temida anulación del laudo arbitral. Finalmente, se analizarán y compararán los diferentes tipos de arbitrajes y las diferencias en cuanto a la normativa a nivel internacional, explorando cómo los mecanismos que corresponden a cada uno de ellos afectan la forma en que se deberían tratar las alegaciones de corrupción.

In order to achieve this purpose, in the first place, it seeks to address and study the current scenario of arbitration and corruption in Peru, in order to lay a foundation for the subsequent analysis of the arbitration practice and its regulations, both nationally and internationally. It then focuses on the role of the arbitral tribunal in the face of allegations of corruption, developing the possibility of ruling on criminal acts, bringing to light different cases that highlight the feasibility of the objective of our research, the application of the principle of sua sponte and the evidentiary standard applied in arbitration. Subsequently, the role of the arbitral award in the face of corruption indications will be developed, delving into the duty of confidentiality, whether or not it is binding and the feared annulment of the arbitral award.
