The purpose of this work is the effects of the opinions that affirm the existence of a breach by a State party within the domestic legal system, as well as the manner in which the execution of the Committee’s decision proceeds. Spanish jurisprudence has been changing, with rulings ranging from the affirmation of the insufficiency of the Committee’s opinion as a prerequisite for a review appeal, to the remittance of proceedings, including the case of CEDAW for which a particular solution was provided.España ha aceptado la posibilidad de que los Comités de Naciones Unidas, creados en aplicación de los tratados de derechos humanos auspiciados por esta Organización Internacional, reciban comunicaciones individuales en las que se les trasladen presuntas vulneraciones del texto del tratado o de sus protocolos y emitan sus dictámenes al respecto declarando o no la existencia de la vulneración indicada. El objeto de este trabajo son los efectos de los dictámenes que afirman la existencia de un incumplimiento por parte de un Estado parte en el ordenamiento interno Estado, así como el modo en el que procede la ejecución de la decisión del Comité.
