This explains why they have an intimate connection with the religious sphere that turns the legal phenomenon in a subordinate and dependent on that categorys the rightis conceived as a part of religion. On the other hand fundamental rights or human rights are rights inherent in every human person by the simple fact that these taxes are virtually all states since the end of World War II and were enacted, and now are in positivised the certain specific legal systems.El ordenamiento jurídico musulmán de carácter personalista de base confesional, a diferencia de otros ordenamientos jurídicos adscritos al sistema jurídico teísta lo fue des de su primer momento de existencia, es decir, es un derecho que solo se aplica y predica por aquellos seres humanos que se hallan integrados en la comunidad de creyentes, dicho de otra manera solo rige a quienes tienen esta religión o en principio así debería ser. Esto explica porque tienen una íntima conexión con la esfera de lo religioso que convierte al fenómeno jurídico en una categoría subordinada y dependiente de aquella; el derecho se concibe, como una parte de la religión.
