In the Peruvian case, this article highlights that the 1993 Political Constitution stipulates that the State must guarantee the public's savings through the correct functioning of the financial system, mainly by establishing mechanisms to protect savers with the sole purpose of creating confidence in the use of the system and basing the participation of the system and the private sector on economic pluralism, free contracting and competition.Los fundamentos constitucionales del derecho financiero desarrollan los pilares sobre los cuales se estructura el sistema financiero. Los autores opinan que resulta relevante revisarlos con la finalidad de considerarlos e incorporarlos en las soluciones que se gestionen frente a los desafíos que actualmente enfrenta el sistema financiero y sus agentes, como son el uso de la tecnología, la educación e inclusión financiera. En el caso peruano, el presente artículo destaca que la Constitución Política de 1993 dispone que el Estado garantice el ahorro del público a través del correcto funcionamiento del sistema financiero, principalmente estableciendo mecanismos de protección al ahorrista con la única finalidad de crear confianza en el uso del sistema y fundar la participación de este y los privados en el pluralismo económico, la libre contratación y competencia.Universidad de Lima.
