Sumario:The constitutional foundations of financial law develop the pillars on which the financial system is structured. The authors believe that itis relevant to review such in order to consider and incorporate them into the solutions to be managed in the face of the challenges currentlyaffecting the financial system and its agents, such as the use of technology, education and financial inclusion. In the Peruvian case, this article highlights that the 1993 Political Constitution stipulates that the State must guarantee the public's savings through the correct functioning of the financial system, mainly by establishing mechanisms to protect savers with the sole purpose of creating confidence in the use of the system and basing the participation of the system and the private sector on economic pluralism, free contracting and competition.
