The objective of this manuscript is to establish the main legal criteria on the application of principles in the argumentation of the judgments of the Constitutional Court, to guarantee the right to legal security in Ecuador. To achieve this objective, a critical analysis of the principles of iuspositivism and iusmoralism was carried out. Iuspositivism refers to the application of the regulations of positive law, that is, existing laws and legal provisions. On the other hand, iusmoralism is based on moral and ethical principles, which may not necessarily be reflected in current legal regulations, whose knowledge allowed us to determine the incidence of principles in the argumentation of sentences and in legal certainty. Indeed, the results of the investigation indicate that the application of both positive and moral principles in the argumentation of the Constitutional Court judgments contributes to guaranteeing legal security in Ecuador. Cause for several judges to vote against certain resolutions that go against iusmoralism, consequently, it is concluded that the application of positive and moral principles in the argumentation of the sentences of the Constitutional Court guarantee legal security in Ecuador.La Corte Constitucional de Ecuador, es el máximo órgano de interpretación de la Constitución, su rol es garantizar la seguridad jurídica en el país, por tanto, sus resoluciones deben estar en concordancia con las disposiciones constitucionales. El presente manuscrito tiene como objetivo, establecer los principales criterios jurídicos sobre la aplicación de principios en la argumentación de las sentencias de la Corte Constitucional, para garantizar el derecho a la seguridad jurídica en el Ecuador. Para lograr este objetivo, se realizó un análisis crítico de los principios del iuspositivismo y iusmoralismo. El iuspositivismo se refiere a la aplicación de la normativa del derecho positivo, es decir, las leyes y disposiciones legales existentes. Por otro lado, el iusmoralismo se basa en principios morales y éticos, que pueden no estar necesariamente reflejados en la normativa legal vigente, cuyos conocimientos permitieron determinar la incidencia de los principios en la argumentación de las sentencias y en la seguridad jurídica. En efecto, los resultados de la investigación indican que la aplicación de principios tanto positivos como morales en la argumentación de las sentencias de la Corte Constitucional contribuye a garantizar la seguridad jurídica en Ecuador.
