Sumario:The Constitutional Court of Ecuador is the highest body of interpretation of the Constitution, its role is to guarantee legal security in the country, therefore, its resolutions must be in accordance with the constitutional provisions. The objective of this manuscript is to establish the main legal criteria on the application of principles in the argumentation of the judgments of the Constitutional Court, to guarantee the right to legal security in Ecuador. To achieve this objective, a critical analysis of the principles of iuspositivism and iusmoralism was carried out. Iuspositivism refers to the application of the regulations of positive law, that is, existing laws and legal provisions. On the other hand, iusmoralism is based on moral and ethical principles, which may not necessarily be reflected in current legal regulations, whose knowledge allowed us to determine the incidence of principles in the argumentation of sentences and in legal certainty. Indeed, the results of the investigation indicate that the application of both positive and moral principles in the argumentation of the Constitutional Court judgments contributes to guaranteeing legal security in Ecuador. Cause for several judges to vote against certain resolutions that go against iusmoralism, consequently, it is concluded that the application of positive and moral principles in the argumentation of the sentences of the Constitutional Court guarantee legal security in Ecuador.
