Este trabajo llena este vacío a través de una evaluación cualitativa de sentencias judiciales de casos de violación contra mujeres víctimas-sobrevivientes mayores de 14 años, emitidas durante el período de 2015-2020, a través de un análisis temático y crítico del discurso. Los hallazgos indican que los mitos de la violación sexual todavía informan la decisión de los jueces en la interpretación de la ley, evaluación de las evidencias y construcción de los hechos. Las implicancias de este trabajo incluyen una mejor comprensión de las fortalezas y debilidades del sistema de justicia penal peruano, el papel de los jueces en la neutralización de los mitos de la violación y la necesidad de explorar medios alternativos para satisfacer las demandas de justicia de las víctimas-sobrevivientes de esta forma de violencia basada en género.

However, very few studies have critically examined if rape myths and other gender stereotypes permeate judicial decision-making and how they do so. This qualitative work addresses this gap by exploring written sentencing remarks of rape cases against female victim-survivors over 14 years-old, from 2015-2020, through thematic and critical discourse analysis. Findings indicate that rape myths still inform judicial decision-making in the interpretation of statutes, assessment of evidence and construction of facts.
