description El presente informe jurídico tiene como objetivo analizar, en primer lugar, las competencias de la Municipalidad Provincial del Santa respecto de la instalación de infraestructura de telecomunicaciones. De forma específica, si es que dicha entidad, en el marco de sus competencias de protección a la salud y cuidado del medio ambiente está facultada a solicitar requisitos adicionales a los establecidos en la normativa sectorial de telecomunicaciones y aplicar una calificación distinta al procedimiento administrativo que debe iniciarse para solicitar la autorización para la instalación de infraestructura de telecomunicaciones. Esto permitirá analizar si es que las disposiciones normativas contenidas en la Ordenanza N° 033-2012-MPS, que regula y reglamenta la instalación de antenas y de estaciones radioeléctricas en la provincia del Santa, constituyen barreras burocráticas ilegales y/o carentes de razonabilidad. En segundo lugar, se analizará si Torres Unidas S.R.L incurrió en un conducta calificada como una infracción administrativa al instalar una infraestructura de telecomunicaciones sobre la base de lo establecido en la Ley N° 29022, Ley para el Fortalecimiento de la Expansión de Infraestructura en Telecomunicaciones y su Reglamento; así como la naturaleza jurídica de las medidas impuestas por la entidad administrativa en el marco del procedimiento administrativo sancionador que inició en su contra por presuntamente haber instalado infraestructura de telecomunicaciones sin contar con la debida autorización.
