Los diversos avances científicos han causado que en diversos países los legisladores se involucren en establecer parámetros legales con la finalidad de coadyuvar en esta problemática. En nuestro país solo hay una norma vinculada a la temática y es el artículo 7 de la Ley General de Salud (Ley 26842). Aquel artículo es la única normativa que regula los casos de maternidad subrogada en el Perú, la cual, si bien no prohíbe taxativamente esta práctica, genera diversas interpretaciones. Ello se incrementa a raíz de que existen vacíos legales en cuanto a la normativa vinculada al tema. Por ello, la finalidad de este artículo es realizar una propuesta de reforma del artículo 7 de la Ley General de Salud referente a la maternidad subrogada.

The various scientific advances have caused legislators in several countries to become involved in the establishment of legal parameters in order to contribute to this problem. In our country there is only one regulation linked to the subject and that is article 7 of the General Health Law (Law 26842). That article is the only regulation that regulates surrogacy cases in Perú, which, although it does not strictly prohibit this practice, generates different interpretations. This increases due to the fact that there are legal gaps in the regulations related to the subject.
