El caso se centra en determinar si los gestos realizados por el señor Mendoza constituyen un faltamiento de palabra en el contexto laboral, y si las acciones de la empresa fueron proporcionales y justas. A través de este estudio, se enfatiza la importancia de la seguridad y salud en el trabajo, especialmente en situaciones que pueden parecer triviales, como las bromas laborales. Se destaca cómo estas pueden derivar en conflictos serios y en la interpretación de faltas graves. Esta investigación proporciona una visión integral sobre cómo los tribunales interpretan y aplican la legislación laboral en situaciones concretas, y subraya la relevancia de un entorno de trabajo seguro y respetuoso.

It examines the legal grounds for the dismissal, the interpretation of gross misconduct under Article 25, subsections a) and f), of the Labor Productivity and Competitiveness Law (LPCL), and the Supreme Court's decision. The analysis explores the interaction between occupational safety and health regulations and dismissal policies, as well as the protection of labor rights.
