El objetivo del trabajo es analizar la postura de las Salas Penales Permanentes de la Corte Suprema en relación al testimonio de las víctimas de violación sexual, menores de 14 años, y analizar, a su vez, cómo el Acuerdo Plenario N°02- 2005/CJ-116 regula la valoración probatoria; esto tiene como objeto de análisis la Casación N° 1952-2018 Arequipa. A este análisis se debe sumar dos aspectos relevantes que aclararán el problema principal; para lo cual, nos apoyamos en el Acuerdo Plenario N°02- 2005/CJ-116 como jurisprudencia, atendiendo a la generalidad con la que fue regulada; el mismo que establece limitaciones para valorar las sindicaciones de las víctimas, porque presenta dificultades en la valoración del criterio de la verosimilitud en menores de edad. Posteriormente, se realizará un análisis sobre la falta de metodología en la psicología forense a nivel nacional para evaluar la credibilidad en las declaraciones de las víctimas menores de edad abusados sexualmente; para luego referirnos a la metodología CBCA-SVA como una alternativa de apoyo para el juez al analizar la valoración sobre la declaración testimonial del menor. Como corolario, la Sala Penal Permanente de la Corte Suprema establece un análisis de valoración insuficiente y conservador sobre los criterios de certeza establecidos en el Acuerdo Plenario actual. Razón por la cual es necesario la implementación de un nuevo acuerdo plenario y la aplicación de una metodología psicológica forense como el CBCA-SVA. |

Razón por la cual es necesario la implementación de un nuevo acuerdo plenario y la aplicación de una metodología psicológica forense como el CBCA-SVA.The objective of the work is to analyze the position of the Permanent Criminal Chambers of the Supreme Court in relation to the testimony of victims of sexual rape, under 14 years of age, and to analyze, in turn, how Plenary Agreement No. 02-2005/ CJ-116 regulates the evaluation of evidence; This has as its object of analysis Cassation No. 1952-2018 Arequipa. Two relevant aspects must be added to this analysis that will clarify the main problem; For which, we rely on Plenary Agreement No. 02-2005/CJ-116 as jurisprudence, taking into account the generality with which it was regulated; the same one that establishes limitations to evaluate the syndications of the victims, because it presents difficulties in the evaluation of the criterion of verisimilitude in minors. Subsequently, an analysis will be carried out on the lack of methodology in forensic psychology at the national level to evaluate the credibility of the statements of sexually abused minor victims; and then refer to the CBCA-SVA methodology as an alternative support for the judge when analyzing the assessment of the minor's testimonial statement. Finally, at the end of this legal report, we concluded that the Permanent Criminal Chamber of the Supreme Court establishes an insufficient and conservative assessment analysis on the certainty criteria established in Plenary Agreement No. 02-2005/CJ-116.
