En respuesta a esta situación, el tribunal emitió el precedente vinculante de la Resolución N°551-2023-OEFA/TFA-SE, en el que resolvió que no se aplica la reforma en peor indirecta en estos casos. Sin embargo, en situaciones posteriores, se adoptó una nueva postura complementaria, en la que establece que, cuando el vicio que origina la nulidad no está relacionado con la multa, la primera instancia no puede aumentar el monto de la misma. Esta nueva postura busca garantizar una mayor protección para los administrados, al evitar que se agrave su situación cuando el vicio no tiene relación directa con la sanción. El informe presenta un análisis crítico sobre ambas decisiones del tribunal, con el objetivo de determinar las mejores soluciones para los administrados en estos casos. Además, se busca ofrecer herramientas que les permitan defender sus garantías procesales y lograr una resolución más favorable en los procedimientos administrativos sancionadores.

In response to this situation, the tribunal issued the binding precedent of Resolution No. 551- 2023-OEFA/TFA-SE, in which it ruled that the worsening reform does not apply in these cases. However, in subsequent situations, the court adopted a complementary position, stating that when the defect causing the annulment is not related to the fine, the first instance cannot increase its amount. This new position aims to provide greater protection for the parties involved by preventing the aggravation of their situation when the defect is not directly related to the sanction. The report presents a critical analysis of both decisions, aiming to determine the best solutions for the parties involved in these cases.
